    SCO's lawsuit asserts that IBM has breached contractual obligations between the two companies, and also that IBM has incorporated trade secret information concerning the design of the UNIX operating system into what SCO calls generally ``Linux.''
    Maybe I missed it but I dont quite understand the dispute's nature unless IBM has been developing Linux which due to my lack of knowledge, I havent heard of.. This true?
    Isn't it strange the onset of overheating will result in freezing?

    The dispute is not about cpyrights or trademarks but about breach for contract.
    IBM has been helping Linux a lot (even using it's coders for kernel development). The reason being that they sell "Enterprise Solutons" and support based on Linux and they need high end features in Linux (multiple CPU's, jfs, memeory management etc.)
    SCO contends that IBM took a look at UNIX code back in the Project Monterrey days (see Google for details), did not go ahead in their collaboration with SCO and instead turned around and injected the UNIX features in the Linux kernel.

    Mr. Torvalds wouldnt have let this take its course even if the guys at IBM really wanted to.

    SCO scared?

    Yes yes I know there are going to be some of you that read the title of this thread and immediately fly off the handle. Let the uninspired/mindless rants come. It happened when SCO made their first announcements. It was even semi-understandable when SCO big wigs publicly entertained the idea of a buyout. However, I just had to post this.


    So here it is.

    I found the last 2 lines rather amusing.

    Form-4 filings with the SEC reveal SCO Executives have been cashing out stock. They made $398,833.90 in June, and $781,964.70 in July (so far)!"

    It's not all cut and dry as you may think. You can read more about it here .

    You should really check out the story from Computer World (link provided in article).

    All in all I don't believe that SCO is "scared" but worried. They have a strong case against IBM (their lawsuit doesn't involve copyright or trademarks according to an attempt to clarify in their amended complaint). They'll have a tough time proving that any of the technologies in question are derivative works.

    I do fully realize that. I realize that that not everyone want to know about every little move that someone is making or rehashing old stories. I just thought it rather interesting.

    I appreciate the news -I am very interested in things that could have an effect on the future of Linux..

    I find the concept of Linux (open source - software by the people, for the people) to be somewhat revolutionary and I would like to see it continue.

    i saw that a bit ago as well. It can be seena s the execs playing it safe, which is bad for the image, since if the execs aren't comfertable with holding the stock, should you be?

    I'm more interested in REAL news that affects the future of Linux, like the latest kernel 2.6 test changelog...

    If SCO wins it does not mean they are going to take over. The offending code will need to be removed, which is a large setback, but things will continue.
    Theres more to Linux then a kernel...

    I don't wanna play the devils advocate here, but what about the code that was pointed out in Linux with programmer's remarks ( INCLUDING TYPO'S!) similar to the ones found in system V? That's sorta...not very cool for the cause. Independent sources confirmed the presence of these lines. Could easily look bad in court.

    I would find it hard to believe that any CEO or high level management would ever be involved in a pump and dump scam, I mean, that would be illegal wouldn't it? They probably wanted to sell now because, with the insider knowledge that they have that their new release will make trillions and the stock will go up at least 1000%, that would look improper. Kudo's to them for doing the stand up thing. There is just no way anyone can make be believe that this isn't all above board...just like Enron, Global Crossing, et all.

    MozillaQuest has a rather nice artcle where the touch on the fact that if SCO does win against IBM it's chances of seeking damages from Linux developers or users is slim to none.

    This too is covered in a large majority of the MQ articles. The code they showed off was not from kernel.org but from an IHV. It was out of context and SCO refused to show that the code actually worked when compiled with the whole. All the expert analysts (Laura DiDio knows nothing about programming, and frankly next to nothing about computers) make note that where the code originated or what proof SCO has it was put there by IBM. Again SCO has not been able to show proof that the code has shown up anywhere except from snipets they're showing from an anonymous IHV.

    I'd have to say: Hold
    The stocks down. Wait for the next outrageous press release or series of letters. The stock price will go up again. Then sell.
