Do you actually know all the facts on the basis of the lawsuit to form a opinion?
Did you sign a petition when Sun sued MS over Java?
Could you please explain to all of us exactly what the lawsuit is about and why we should side with IBM?

I don't know about the author of this thread but the fact that SCO have claimed that IBM turned Linux into an enterprise quality product when it wasn't before they got involved is a bit cheeky!
If i was one of main Kernel developers, i'd be quite insulted by that. Still, from what i've read it doesn't seem IBM are too worried about the case. Or that SCO think they will win (exit strategy conspiricy anyone?).
The most amusing thing i heard about it was to do with the main complaint (that IBM gave UNIX code to their Linux developers).....
It was a quote from an IBM employee (allegedly) who scoffed at the idea of the Unix guys giving code to the Linux guys saying that they don't even give them the time of day

To imply that any single member, whether human or corporation, of the GNU/Linux community was solely responsible for its capabilities is amazingly naive. If anything GNU/Linux is so collaborative that it can be a drawback sometimes.

This line made me giggle
We have evidence that portions of UNIX System V software code have been copied into Linux and that additional other portions of UNIX System V software code have been modified and copied into Linux, seemingly for the purposes of obfuscating their original source.
In otherwords...."We think that this could be a re-write of the code that we have patent rights on, so we own it, even though it doesn't look like our code, it does the same thing as our code...so it's our code"

Odd that they wait until IBM becomes involved in the implementation of Linux. I wonder if it has anything to do with "Deep Pockets". It seems they have also put any further developement of SCO on the back burner until this is resolved. Sounds like they are planning semi-retirement from the proceeds of their law-suit.

Um, I posted something similar on Linuxtoday, but I think it's important enough to throw in here as well. SCO is implying with that little press release, that they will go after commercial users as well, not just people that distribute Linux. If that's not a major boost for MS, nothing is.
Like I wrote earlier, we need to (along with IBM, Redhat, SuSE, EFF, and so on), make it clear to the world that SCO's lawsuit is full of hot air, and possibly legally go after them in a countersuit for implying that corporate customers are breaking the law before the lawsuit has been decided. This is a clear libel case, if there ever was one.

What gets me is that thousands of students have been brought up on unix they have studded the code and now they think unix. Is it their fault that the code they write looks like unix? I think not.

SCO is trying to embrace & extended UNIX & Linux <cough> .
I also agree with johnt's comment. I think SCO was looking for a company with deep pockets.
SCO didn't really have a big target to go after before IBM how long have they held the patent's to UNIX? I think for quit some time. They haven't said or done anything up until this point
SCO is gasping for air I hope big blue fights them tooth & nail.

As far as the time thing goes, I wouldn't be too surprised if they tried to say that their name change nullifies any decisions made previously. And while it wouldn't surprise me if MS tried to buy SCO, even the worst FTC people couldn't argue in favor of that. Literally, MS would own all rights to all operating systems. Okay, maybe not all, but can you see them suing the BSD's again? Everybody in the computer/technology industry might have a little something to say against that idea, even the ones that kiss MS's tail.

Besides, I'm not sure of this, but their monopoly status pretty much means they can only increase their share of the industry if they lose significant share, i.e., their monopoly. I just can't see MS telling their stockholders they're losing their desktop monopoly to linux. Might leave them in the same situation SCO is in.

More likely, they'd try some of the twisted company ownerships things like worldcom did. Have a board member, in charge of a company that's owned by another company that's owned by another company and so on, buy SCO, then just do MS's bidding anyway. Hmmm, SCO seems to be doing that already. I just wonder which companies were involved.

Would it be worth it to IBM to buy SCO? I bet that if they had the UNIX code and could do whatever they wanted with it that they'd do some nice things knowing their support for Linux. Why would SCO go after Linux instead of *BSD? Wouldn't the BSD code be even more like their UNIX system V's? It seems like they're either trying to support MS by killing Linux or trying to become a MS itself.

My $.02 on the whole SCO thing-
1) Why didn't you say something in '93 or '94 then? Why wait until now, when Linux is a thriving medium?
2) Prove it's your code then. If it looks EXACTLY like your code, then you win. Otherwise, unless there's a comment line in there that says "THIS IS UNIX CODE COPIED FROM System V," maybe some coder just wrote code that did something similar and looked kinda like it.
3) GO IBM! Countersuit- Libel, legal fees, lost wages... GO ALL OUT! Stick it to 'em!
I don't claim to be an expert, please remember that the above is just my rambling, probably long-winded opinion.

Of course deep pockets has everything to do with it. If SCO was so damn concerned with the Linux kernel why the hell haven't they sent a cease and desist order to Linus. It's simple they won't get paid that way.
